Atanas Slavov: The situation created around Sarafov is a political-prosecutorial attempt to overthrow the judiciary

The big question is how long we will tolerate this state of affairs - the prosecution is above the law, the person performing the functions is committing direct violations of the law, asked the former Minister of Justice

The situation created around Sarafov is risky for the rule of law. This was stated to the Bulgarian National Radio by Atanas Slavov, a member of parliament from the PP-DB party, former Minister of Justice.

"Borislav Sarafov is a former acting prosecutor general. This is a political-prosecutorial attempt to overthrow the judiciary. It is unacceptable in a state governed by the rule of law for the prosecution to give any instructions to the court. The current situation is indicative of all the problems we have talked about in recent years. It is also the result of that unfortunate decision of the Constitutional Court from last year, by which the key changes in the judiciary, which were supported by the expert communities and our European partners, were declared invalid and unconstitutional. If the changes had remained in the Constitution, this situation would not exist. We would have had new elected bodies, and the Prosecutor General would have had reduced powers.

The norms in the law say that it is applicable to existing cases, Slavov noted in the program "Nedelya 150".

"This is a principle in law. For more than two months, Mr. Sarafov has been exercising functions in violation of the law. This situation must be terminated in accordance with the law. It is necessary to select a new acting SJC member.

The deadline, which expired on July 21, has been established as a legal fact by the Supreme Court of Cassation, the former Minister of Justice noted.

"The big question is how long we will tolerate this situation - the prosecutor's office placing itself above the law, the acting member committing direct violations of the law.

One of the possible steps to get out of this situation is for the Minister of Justice to convene a meeting of the SJC and discuss this problem".

The responsible position is to participate in the process of selecting the quota of the National Assembly in the SJC, Atanas also emphasized Slavov.

"But the majority has not initiated such a conversation.

There is a majority in this parliament for the election of the VVS without Peevski's "New Beginning".

Slavov defined the prosecutor's office as a "spy command that obeys a will external to the judicial system".

"The prosecutor's office is beyond any form of democratic accountability. This problem can at least partially be solved at the legislative level".

The PP-DB MP commented on the situation on the Bulgarian Black Sea coast, where tragic incidents occurred after torrential rains.

"This is about criminal negligence, this is not just a natural disaster. When we have construction in places where there should be no construction, when we have the diversion of the flow of rivers in order to create a new holiday village or a new hotel, it is clearly a matter of accumulating corrupt influence. Someone along the chain has not exercised power and has turned a blind eye.

There should be periodic control of the riverbeds, cleaning, strengthening where necessary, monitoring the situation after such heavy rainfall. There is money, the question is how it is managed".

He believes that it is mandatory to begin demolishing illegally built hotels, "if we want to prevent such situations".

There will be other votes of no confidence in the coming months, Atanas Slavov also noted.
