A prosecutor at the Sofia District Prosecutor's Office has filed a protest against the acquittal of Lena Borislavova by a panel of the Sofia District Court for the fact that, in the context of an ongoing crime involving two acts, she knowingly used false private documents, which were made to appear to have been signed by members of the "Let's Save Coral" Association. This is reported by the SRP.
Borislavova has been brought to criminal liability for the fact that on 13.05.2021 at around 01.55 in front of an official at the Registry Agency in the city of Sofia, she knowingly used false private documents – Declaration under Art. 13, para. 4 of the Law on the Protection of Private Persons; List of all members of the non-profit association “Let's Save Coral“ as of May 06, 2021; Protocol regarding the posting of an invitation to convene a General Meeting of the “Let's Save Coral“ Association dated 20.04.2021; Invitation to convene a General Meeting of the Association “Let's Save Coral“ and Minutes of the General Meeting of the Association "Let's Save Coral", which were given the appearance that the signatures on the documents were affixed by A.R. - Chairman of the Management Board of the Association "Let's Save Coral", and by M.D. (member of the Association), but were actually not affixed by them. Borislavova also used a power of attorney, with which she was authorized, which was given the appearance that the signature on the document was affixed by A.R., but was actually not affixed by him.
On 14.05.2021 at around 11.45 am, in front of an official at the Registry Agency, Lena Borislavova knowingly used the following false documents: List of all members of the non-profit association "Let's Save Coral"; List of all members of the Association who attended the General Meeting held on May 6, 2021; List of all members of the non-profit association "Let's Save Coral" as of April 19, 2021 and Minutes of the meeting of the Board of Directors of the "Let's Save Coral" Association, which were given the appearance that the signatures on the documents were affixed by the Chairman of the Board of Directors of the "Let's Save Coral" Association and by its members, but in fact were not affixed by them. The PP-DB MP again used the power of attorney that she presented the previous day.
She is accused of knowingly using the false documents, as they were used to prove that the legal relationship between Kiril Petkov and the Association "Let's Save Coral" was terminated, and she cannot be held criminally liable for the preparation of the documents.
On 18.11.2025, a panel of the Sofia District Court ruled an acquittal against Borislavova. The supervising prosecutor disagrees with the verdict and finds the act, guilt and authorship of the defendant to be indisputably proven and continues to uphold the accusation against her, which is why a protest was filed today, 19.11.2025. It states that a qualified electronic signature has the same legal value as a handwritten signature and that the holder should not allow its use to be publicly accessible. Furthermore, in her explanations to the court panel, the defendant did not provide any specific information regarding any possible unlawful use of her electronic signature, nor did she provide any information that she had reported such an act to the relevant competent authorities and the provider of the electronic signature.
Given the fact that the reasons for the sentence were not clear in the courtroom, the supervising prosecutor will supplement the protest as soon as the court panel announces the reasons for its decision.
