Three times a man lost his license because of a false positive drug test

Laboratory tests showed that the field test was wrong

25-year-old Tsvetomir Borisov from Montana was stopped for a third time in a row for a roadside check and his test showed a positive result for drug use. In two of the three cases, laboratory tests proved that the man had not used drugs. The man claims that when he was first arrested, the uniformed officers convinced him not to give blood samples, which led him into a trap. And so for years, every few months, the young man remained without a driver's license, without the right to drive a car and with limited opportunities to work and lead a normal life.

"The first time I was stopped, the field test turned out to be positive for amphetamines. I was tricked into not giving a blood sample because they told me that the procedure was very slow, the expertise would be delayed and that in six months everything would be over faster. I agreed and decided not to give blood because I didn't know how things were. They detained me and later I realized that in this way I had convicted myself", the victim Tsvetomir Borisov told Nova TV.

Afterwards, his lawyer told him that he shouldn't have signed the report and that he should have given a blood sample since he hadn't used amphetamines.

"The first time I was stopped in Montana, in front of the traffic police building in the city. The police told me that there was no way the test could be wrong, even though I told them that I hadn't used drugs. After we went to the hospital in Montana to give a blood sample - a police officer said to the doctor who was taking my blood: “Can I talk to him?“. He and his colleague started to dissuade me from giving blood. They told me: “It's better for you. I'm telling you this in a friendly way - don't give blood. Then it will get much worse“. I trusted them and didn't give blood,” said the victim.

Tsvetomir added that he was told that this was the procedure by law and that they had to detain him, and after 24 hours they would release him. “I agreed. I was left without a driver's license for a year. They sentenced me to 4 months suspended with 3 years of probation”. he said.

The second time he was stopped in the town of Berkovitsa for a check. "This was in November. They did a test on me and it came back positive again. I tried to convince them that I didn't use drugs, but they didn't care. They said that only a blood test would prove the truth. I gave a blood test and it came back negative. They returned my license and everything ended relatively quickly", he said.

And he added: "After some time - in February of this year, I got my license back. In June, I was stopped for a check in Tsarevo, more precisely - in the village of Sinemorets. There I tried to convince the police again and told them that I had documents and clean expertise that I didn't use drugs. After the field test, they told me that it was positive for amphetamine. The policeman explained to me that the test was expired, unwrapped it, and told me to rub the swab in my mouth until it turned blue. They recently called me and told me that the blood test was clean and asked me where to send the documents for the discontinued proceedings".
