The Burgas Court of Appeal confirmed the ruling of the District Court and remanded Nikola Burgazliev in custody, accused of the ATV accident in Sunny Beach, in which a young woman died and her child was seriously injured. This is reported by Nova TV.
The magistrates accepted that all legal prerequisites for continuing the measure of “detention in custody“ were present, with the reasons being the real danger of the accused absconding, as well as the gravity of the charges.
During the court hearing, Burgazliev's parents stated that their son had not used drugs and that, in their words, he was a victim of public pressure.
“I continue to think that he did not use drugs. The blood sample was taken 30 hours after the incident. For us, this is manipulation“, said the mother of the accused, Rosa Raleva.
The parents also commented that, in their opinion, a negative public attitude is being created against their son, which is also affecting the trial.
The defense, represented by attorney Koleva, requested the prosecutor's recusal in the case, as well as a change in the detention measure.
“We are in proceedings to change the detention measure, not on the merits. We have assessed that the legal grounds for its change are present“, said attorney Koleva.
