The Prosecutorial College confirmed its decision to appoint Borislav Sarafov as Acting Prosecutor General

The decisions of the College can be appealed to the Supreme Administrative Court

The Prosecutorial College of the Supreme Judicial Council (SJC) confirmed its decision to appoint Borislav Sarafov as Acting Prosecutor General, the SJC announced.

For this reason, no administrative proceedings were opened to appoint a new Acting Prosecutor General.

The decisions of the College can be appealed to the Supreme Administrative Court (SAC) within 14 days.

They were taken in connection with a letter from Daniela Taleva – prosecutor at the Supreme Cassation Prosecutor's Office, Acting Prosecutor General prosecutor for the investigation of crimes committed by the Prosecutor General or a Deputy Prosecutor General.

Prosecutor Taleva has requested the provision of a certified transcript of the minutes of the Prosecutors' College of 9 July 2025, containing information on the discussion held on the application of the provision of Art. 173, para. 15 of the Judicial System Act (JSA).

Taleva points out that upon early termination or expiration of the mandate of the Prosecutor General, the President of the Supreme Court of Cassation or the President of the Supreme Administrative Court shall be designated as temporarily performing the relevant functions, subject to the following condition: the same person shall not have the right to perform the relevant functions for a period longer than six months, regardless of whether there have been interruptions in the performance of the functions.

With decisions of today, the Prosecutors' College established that Borislav Sarafov has been designated as performing the functions of „Prosecutor General of the Republic of Bulgaria“ by virtue of a decision of the college of June 16, 2023, which entered into force.
