The Perniški District Court stopped the demolition of the illegal hotel of Rumen Gaitanski, located on the shore of the Iskar dam. The district judges in the mining town made their decision in record time - in 24 hours, and on the basis of one claim, without evidence. And with the motive of collecting evidence, reports BNT.
The capital municipality filed an appeal against the suspension of the demolition, but the Pernik court has not ruled for 40 days, despite the initial speedy actions in the case.

On June 7, Friday, the company "Forest Troll" filed a claim in the Pernish District Court, in which he claims that another company owes money for construction and installation work on the completion of the hunting hotel near the Iskar Dam.
On the same day, a commercial case was initiated, and the plaintiff was notified. On Monday, June 10 "Forest Troll" submits a new application - for collateral.
Judge Velkova immediately renders a decision in which he respects the request. On June 11, the warrant was issued, and the document traveled 40 kilometers to be delivered the same day to the Metropolitan Municipality.
"The court issues the injunction as an explanation that the commercial dispute between the two companies can only be settled if the evidence, namely the building, in the eyes of the court, is available and can be inspected and examined in within the framework of the legal process", said Nikola Lyutov, Deputy Mayor of Sofia.
Thus, with the definition, the court turns the illegal building into evidence. According to our sources, this is despite the fact that to the Claim "Forest Troll" he did not present documents that he was assigned construction and assembly activities, nor documents for the costs of the execution of the contract for which he claims he should receive payment.
"That is, when the work is done there is some documentation that is signed, it should be sufficient. Even if we assume that the building is the evidence and not the documentation, why the court did not allow a preliminary inspection, but proceeded directly to stop the forced execution, for us it is a mystery", added Nikola Lyutov.
The only specific thing alleged in the claim is that the contract for the completion of the hunting hotel was concluded with the contractor on January 3, 2021. Although it is a Sunday, the last day off from the New Year holidays, the court finds no reason to doubt and verify the circumstances of the signing of the contract.
"The company is called "Forest Troll", some people may take it humorously, some may take it as a demonstration of impunity, an insult to the institutions,", commented Nikola Lyutov, Deputy Mayor of Sofia.
The company "Forest Troll" itself is registered in the Sofia village of Zhiten with a subject of activity, you correspond to its forest name - logging, wood processing and trade in wood. The manager of the other commercial company, against whom the case was filed, turns out to be "The Handed Shiva". - he is the manager of more than 100 companies, and there are more than 200 registered commercial companies at his address.
"Overall, the request is strange and strongly suggests a simulative process, such as doubts about me and my team," added Nikola Lyutov.
Doubts are also strengthened by the fact that the company that allegedly owes "Forest Troll" is not the owner of the hunting hotel and no evidence has been presented that he has a contractual relationship with the owner of the illegal construction. However, it turns out that these circumstances do not matter to the Pernik District Court.
"In addition, we have filed a report with the prosecutor's office. The prosecutor's office refuses to initiate pre-trial proceedings. We have filed a report with the Inspectorate of the Supreme Court. They claim that there is not enough data in our report to even launch an investigation into the case," said Nikola Lutov.
Another rescue of the illegal hunting hotel caused the municipal councilors from GERB - SDS to attack the mayor of Sofia again.
