The court finally overturned the ordinance on alcohol and drug tests for police officers

The Supreme Administrative Court (SAC) finally overturned the ordinance regulating alcohol and drug tests for police officers.

With their decision, the supreme magistrates confirm the ruling of the lower instance.

The text currently in force is from July 2020 and controls the conditions and procedure for establishing the use and abuse of narcotic substances or their analogues in the Ministry of Interior.

The ordinance was challenged before the Supreme Administrative Court by the Central Police Union of the Ministry of Interior.

When issuing the ordinance, significant violations of the administrative and procedural rules under the Law on Normative Acts were committed. This, according to the magistrates, is the reason for the document to be annulled.

From the content of the reasons for its adoption, the first instance found that the requirement to indicate the financial and other resources necessary for the implementation of the new regulation was not met.

The five-member panel accepted that the first instance, based on the evidence collected, reached justified legal conclusions - violations of the administrative and procedural rules were committed in its issuance.
