Constitutional Court: Confiscating cars from drugged and drunk drivers is not unconstitutional

The Court declared unconstitutional the provisions according to which a fine is imposed in the amount of the market value of the vehicle, if it is not owned by the driver

The Constitutional Court left in force the provision of the Criminal Code by which cars are confiscated from drugged and drunk drivers. The personnel officers did not find a contradiction with the basic law, the Constitutional Court reported.

The decision was made with 7 votes "For". It was signed with a dissenting opinion by Pavlina Panova, Nadezhda Dzhelepova, Sonya Yankulova, Borislav Belazelkov and Galina Toneva.

All constitutional judges participated in the session.

The court declared unconstitutional the provisions according to which a fine is imposed in the amount of the market value of the vehicle if it is not owned by the driver.

In April 2024, the Constitutional Court was referred to the General Assembly of the Criminal Chamber of the Supreme Court of Cassation (OSNK of the SCC).
