Zinaida Zlatanova: There is no way to read a law in several different ways - 1

An attempt is being made to maintain a status quo that is unsustainable. But, if we abstract from the specific case, because it is not the only one, we have the Supreme Judicial Council out of mandate for more than 3 years, we have the Supreme Judicial Council Inspectorate out of mandate… but why is this a problem – because mandate, electability and the separation and mutual control of powers are the foundations of democracy, and we very easily give up on them. This erosion of the rule of law will have a very bad effect on us. And someone thinks that they will gain something – there will be none, there will be no winners and this will have a very bad effect on our entire society. This was said in the program "Face to Face" on BTV by Zinaida Zlatanova, former Minister of Justice.

There is no way to read a law in several different ways. European Union law does not allow the Inspectorate at the SJC to continue to control the activities of judges and prosecutors. This applies by analogy to the SJC itself. Currently, the acting chief is not in a regular mandate, he is a temporary solution. If this were a regular mandate, the law should apply to the next mandate, but he is performing the functions, so let's say that some principle is being violated, as the prosecutor's college claims, the former Minister of Justice pointed out.

There is an attempt to transfer the case from the sick head to the healthy one. In this case, the court is not violating the law, but restoring the legal order. The fact that the court is trying to restore the legal order in this way is a very positive signal. This gives me hope that the immune system of the judicial system itself is working. Above all, the solution must come from there. Democratic legitimacy cannot be restored from the outside, and without democratic legitimacy, even ordinary citizens feel that something is wrong - trust in the justice system is falling year after year, Zinaida Zlatanova also said.
