The unknowns are those that could affect the date of future elections. We must divide the provision of Art. 99 into two parts - the attempts to form a regular government within the National Assembly and the fact that there is no deadline for the president to hand over this mandate, the second is when a mandate has been handed over for the third consecutive attempt to a parliamentary group to form a government. The Constitution does not provide for a deadline for the respective parliamentary group to return the folder to the president with an attempt to form a government. This was stated by constitutional judge Orlin Kolev in the program “Face to Face” on BTV.

In the second phase comes the so-called caretaker government. From the short life of the provision of Al. 5 of Art. 99 of the Constitution, a diverse practice was created - in one case the president gave the candidate for prime minister the opportunity to immediately appoint the caretaker government, while in the other case he expressed his will and disagreement with the proposed cabinet. And here comes the big question besides the appointment of a caretaker government and the organization of parliamentary elections, he recalled.

Since the parliament is unable to elect a government, it is unable to exercise the power given to it by the people. In this sense, the idea is to provoke elections, not the formation of a caretaker government. Therefore, the possibility of forming a caretaker government should not be tied to the holding of future parliamentary elections, Kolev explained.

If everyone refuses to be prime ministers, then the regular cabinet remains in operation, the constitutional judge explained. “The idea of the caretaker government is to ensure the transition. In this sense, the focus is on the elections, not on the caretaker government," Orlin Kolev specified.
