The decision of the Constitutional Court in the case related to the resignation of President Rumen Radev can be expected within days. This was commented by constitutionalist Prof. Plamen Kirov in the studio of "Denyat ON AIR".

"In this case, since there is no specific deadline within which the court can rule, the principle of, so to speak, a reasonable deadline applies. And the reasonable deadline, in other words, is at the earliest opportunity. "It is not so important a day or two ahead or behind," Professor Kirov told Bulgaria ON AIR.

According to him, the case is not a typical constitutional case, since there is no dispute, but only the establishment of an indisputable fact - a submitted and publicly announced presidential resignation.

"The Constitutional Court simply, based on the submitted resignation, must terminate the powers of the President of the Republic and by virtue of this decision, the Vice President immediately continues the mandate for which the two were elected together," explained Professor Kirov.

He emphasized that Yotova will lead the consultations on forming a caretaker government. The constitutionalist warned that there is no formal legal obstacle to the election of an acting prime minister for certain candidates, but it is possible that legal risks may arise in the future that could cast doubt on the legitimacy of the appointments.

According to him, early elections cannot be scheduled without an acting cabinet, and a vote by the end of March seems unlikely.

"I can't guess, but in fact they won't be by the end of March. What is emerging. They won't be at the beginning of April either, since we are still entering some holidays", commented Prof. Kirov.

However, any delay will be interpreted politically and will give rise to speculation.

Regarding the election process, the constitutionalist expressed skepticism towards machine voting and emphasized that the fairness of the elections depends mainly on control in the sectional commissions and the presence of advocates, and not on the technology used.
