There absolutely cannot be a vote of no confidence in the caretaker government. Politically, they can criticize him, ask topical questions, ask questions to the ministers, but realization of political responsibility cannot be sought even after the constitutional changes, because the National Assembly did not elect the caretaker government, but the president, and he is responsible for it. This was stated by lawyer Prof. Borislav Tsekov in the program “ More from the day” according to BNT.
„There is an interpretive decision from 1992 and it carries the same message. There has never been any other interpretation under any circumstances. Even the Constitution distinguishes a caretaker government from a Council of Ministers. The vote of no confidence is against the Council of Ministers, that is, the government appointed by the parliament, he explained.
„At the moment there is a very serious party controversy, but this issue cannot be resolved with a vote of no confidence”, Tsekov is categorical.
Regarding the deadlines, even with the new configuration of the government, the procedure is 7 days, he stressed.
„The President cannot refuse because the decision is binding. It can only do so through political dialogue. The most extreme measure is, if the president has such strong objections, to replace the acting prime minister and thus the entire cabinet, but this seems to me to be a rather extravagant decision, the lawyer explained.
