Sarafov requested the immunity of Kiril Petkov due to the arrest of Borisov  - 1

I.f. Chief Prosecutor of the Republic of Bulgaria Borislav Sarafov submitted to the 51st National Assembly a request to remove the immunity of the People's Representative Kiril Petkov. The request is based on the proposal of the Sofia City Prosecutor's Office (SGP) in connection with an ongoing investigation.

Many witnesses were questioned in the case, written evidence, video recordings and others were requested and submitted. The supervising prosecutor from the SGP has assessed the evidence collected so far as sufficient to bring criminal responsibility and bring charges against K. Petkov for the fact that on 17.03.2022, in his capacity as a person holding a responsible official position, namely – “Prime Minister”, exceeded his authority by unlawfully ordering the head and the deputy head of the department “Investigation and methodical guidance of the investigation” at the GDNP, as well as the Chief Investigating Police Officer at the GDNP, to initiate pre-trial proceedings in violation of the Code of Criminal Procedure against persons over whom they have no authority. In addition, as Prime Minister K. Petkov demanded that the investigating police officers conduct an interrogation with him without notifying the competent prosecutor at all. It was also ordered in the homes of three Bulgarian citizens – Boyko Borisov, Vladislav Goranov and Sevdelina Arnaudova, to carry out searches and seizures without the permission of the relevant court and in the dark part of the day, as in the case there were no grounds for urgency.

In addition, K. Petkov ordered the director and the deputy director of the GDNP-MIA to order their subordinate police authorities to detain for a period of up to 24 hours the persons B.B., Vl.G. and S.A., with the aim of causing them harm, expressed in damage to their prestige and their good name in society, and as a result, significant harmful consequences for the state have occurred – damaging the prestige of the executive power – crime under Art. 282, para. 2, top para. 1 NC.

As a People's Representative K. Petkov is a person with immunity, and according to Article 70 of the Constitution of the Republic of Bulgaria, the initiation of criminal prosecution against him is possible only with the permission of the National Assembly or with the written consent of the representative of the people, reports the prosecutor's office.
