The District Court in Varna granted the request of the District Prosecutor's Office to take a preventive measure of "detention in custody" against a 24-year-old young man, brought as a defendant for having intercourse with a person under the age of 14, as long as what was committed does not constitute rape - a crime under Art. 151, paragraph 1 of the Criminal Code.
He has been charged with having sexual intercourse with a 12-year-old girl on February 14 this year in Varna. The victim is a child deprived of parental care, placed in a specialized institution.
The penalty provided for by law for such a crime is imprisonment for 2 to 8 years.
The 24-year-old defendant was convicted of a crime of a general nature, and the current act appears to have been committed during the probationary period of the punishment imposed on him with a previous conviction. From the written and oral evidence in the case, the District Court accepted that a reasonable assumption of complicity can be made. In view of the high public danger of the act, as well as in order to prevent the possibility of the accused absconding or committing another crime, the court considered that the most adequate measure of deterrence against him was "detention in custody".
The appeal of the measure is within 3 days, and in the event of an appeal, the case is scheduled for consideration before the higher court instance – the Supreme Administrative Court, on February 25 at 1 p.m., Focus reports.
