The Supreme Court of Cassation will make a decision within a deadline on the murder of Dimitar Malinov from Tsalapitsa, it became known at today's court session. The defendant in the case is Rangel Bizuryev.

According to Bizuryev's lawyer - Delcho Dzhubeliyev, procedural violations were committed, and the imposed punishment is unfair. He added that according to the expert reports, the intentionally caused bodily injuries were minor, and the serious bodily injury that led to Dimitar's death was due to negligence.

"This is an inhuman beating that was in no way provoked by the deceased," said the lawyer for the private prosecutors, Dimitar Markovski. He insisted that the Supreme Court return the case to the lower court, BTA reports.

"I regret what happened. I knew I was bigger and stronger than him and I didn't want to kill him. He was 24-25 years old, I was 30 years old then, I was starting to think about home and family. I ruined both the life of mother Atanaska Bakalova and mine", Rangel Bizuryev said in his last words before the court. He added that he is left-handed, and the broken ribs are on the right side.

The prosecutor's office called on the court to respect the request of Bizuryev's lawyer, because the expert reports show that the beating was carried out in a particularly cruel manner, and they also called on the court to return the case to the lower court.

All bodily injuries inflicted with blows are minor, according to modern medicine. As a result of one of them, in the nose, bleeding occurs. Over time, this minor bodily injury develops into a serious one, which results in death. When the blows were inflicted, no other than minor injury was inflicted, lawyer Dzhubeliev told the media.

He commented on the prosecutor's office's opinion, according to which many blows were inflicted with very strong intensity and particular cruelty, saying that it is the prosecutor's office's sovereign right to decide against whom and what charges to bring. He explained that the cassation appeal was the same as the one before the appeals court.

"I hope that the case will be returned to the Court of Appeals and that Bizyurev will receive his life sentence. This is a fair punishment for what they did to Mitko. All those who participated should have been charged with this crime and given a life sentence," Atanaska Bakalova, mother of Dimitar Malinov, told the media.

She added that she believes that this will be the result if the Supreme Court returns the case to the appeals court. "At the first instance, the twins were supposed to give testimony, but they refused, as well as eyewitness accounts. They broke the law in the District Court. One of the twins refused the testimony he gave a year earlier. Expert opinions that were requested by my lawyers were rejected by the court. I hope the case will be returned and we will still have fair judges. Mitko did not deserve such a death," Bakalova also said.

In April last year, the Plovdiv District Court imposed a sentence of 15 years in prison under an initial strict regime on Bizyurev for the murder of Malinov. The twins Valentin and Borislav Dinkovi, who helped him bury Dimitar's body near the village, were sentenced in two instances.

On March 20 last year, the Plovdiv District Court increased the sentences of each of them. Borislav Dinkov is sentenced to four years and six months in prison, and Valentin Dinkov - four years in prison. Their sentences are final.
