Will the Municipality of Nessebar remove the restaurant "Amore", built literally on the beach in the resort complex "Elenite"? This is a question that is once again on the agenda after the tragic flood, which took four lives and left many owners without property in the area. The search is still on to find out who is responsible for the construction of the ravine in "Elenite" and for the fact that the river has literally "disappeared" from the cadastral maps to make room for new buildings.

But this is only part of the tragedy with the flood. As is known, the Regional Directorate of Construction and Land Management - Burgas has issued an act stating illegal construction in "Elenite". We are specifically talking about the construction that has narrowed the riverbed - embankments and concrete structures, which are practically located under the “Negresco“ hotel. There is also an act of illegal construction for the built “Atlantis“ water park. They should be removed.

Then, the head of the DNSK Lilyana Petrova explained that after such an act is issued, the DNSK will refer the case to the prosecutor's office for possible violations in the issuance of construction permits. If the construction permits are canceled as illegally issued, the illegal construction will have to be demolished - at the expense of the owners.

The editorial staff of FAKTI received a signal that is again related to the “Elenite“ resort complex. The case already has a legal history, but we have to see whether the Municipality of Nessebar will follow the legal path to the end - and most importantly, how long it will take.

Since 2018 - illegal construction on the coast
In 2018, construction of a new building for a restaurant in the apartment complex "Talyana Beach" began next to the "Messembria Fort Beach" complex. Already with the first excavation works, owners of the "Messembria" complex filed complaints, as the construction falls into a restrictive zone "A" and violates the norms of the Spatial Planning Act (SPA) and the Black Sea Coast Planning Act (BSCLA).
According to the complaints, the restaurant is being built only 5-6 meters from the beach, and the overall development in "Talyana Beach" exceeds the permissible intensity coefficient.

Complaints, protocols, but and… ongoing construction
In the period 2018-2020, numerous complaints were filed with the Municipality of Nessebar, the Ministry of Tourism and the Regional Governor of Burgas. Despite this, the construction has not been stopped and the restaurant is somehow completed and operating!?
On November 14, 2019, the Regional Directorate for National Construction Control - Burgas (RDNCC) found violations and ordered the suspension of all construction and installation works. An order to remove the illegal construction was also issued, signed on April 1, 2020.

Court battle and final court decision
A case was reached, which resulted in several court decisions and appeals. Ultimately, the court upheld the decision of the Nessebar Municipality to remove the illegal building - a two-story restaurant "Amore", built on a property right on the seashore.
The deadline for voluntary implementation expired on October 30, 2025, and the local administration has already taken action for actual removal.
According to information from FAKT, the municipality's draft budget for 2026 includes funds for the demolition of the site, as well as the preparation of a safety and construction waste management plan.



Will there be an end to the six-year saga?
Now the question is whether this will be the end of a six-year saga, because since the owner does not remove the object, the municipality must do it.
If everything goes according to the law – according to the deputy mayor of Nessebar Municipality Viktor Borisov – in 2026 the restaurant “Amore“ in “Talyana Residence“ should be removed.

We will continue to monitor the development of events, because building by the sea is always “interesting“, but when it is not legal – what comes next?

Or do we need new victims to take measures?
