The District Prosecutor's Office in Lovech protests the measure of "house arrest" of the head of the Fifth Regional Department of the Ministry of Internal Affairs in Sofia Plamen Maximov.
He is accused of participating in an organized criminal group for arson, bribery and drug distribution. Out of a total of five defendants, three are under a preventive measure of "detention in custody", and two – under – house arrest", BGNES reported.
On December 16 and 17, a panel of the District Court – Lovech granted three out of five requests of the District Prosecutor's Office – Lovech to impose the most severe preventive measure “Detention in custody“. They are against five people, two of whom are officials (police officers), accused under Art. 321 of the Criminal Code.
According to the state prosecution, the leaders of the group are R. K. K. and E. B. M., and the group itself operated during the period 2023 - 2025 with the aim of committing various crimes on the territory of the country.
Taking into account the statements of the parties to the trial and the evidence presented in the court hearings, the court determined: For R. K. K., accused of having led alone and together with E. B. M. an organized criminal group with the participation of five more persons, a preventive measure “detention in custody“ was taken.
With regard to E. B. M. – accused of leading, alone and together with R. K. K., an organized criminal group with the participation of five other persons, as well as of complicity in arson of a building in the Lovech village, the court took a preventive measure of “detention in custody“.
With regard to Y. S. B, who, according to the state prosecution, participated in the organized criminal group with six other persons and committed arson of a commercial facility with adjacent machinery and goods in a village in the Lovech region, the court accepted that the two prerequisites for taking the measure “detention in custody“ for the accused were present.
With regard to K. E. N – accused of participating in an organized criminal group with six other persons and in drug distribution, the court accepted that there was evidence of complicity in committing a crime under Art. 354a of the Criminal Code (possession of narcotics for the purpose of distribution), but not for a crime under Art. 321, para. 3, item 2 (participation in an organized criminal group), therefore a preventive measure of “house arrest“ was taken against him.
The prosecutor's protest will be considered by the Court of Appeal in Veliko Tarnovo on Tuesday, December 23.
