New judge takes over the "Coral" case against Lena Borislavova

The defense pleads that Borislavova was investigated even before her parliamentary immunity was requested

A new judge takes over the "Coral" document fraud case, in which Lena Borislavova from the PP is accused. This means that the trial must start from the beginning, since the principle of immutability of the judicial panel applies in criminal law. The reason for the change is that the current chairman of the panel will be absent for an extended period. All her cases will go to another judge, i.e. they will not be reassigned, because the new magistrate will take over the entire panel.

In practice, not much has been done in Borislavova's case, so returning it to its original position does not extend it by more than one session. So far, the Sofia District Court has decided to hear the case only administratively, i.e. if Borislavova is found guilty, she will not be convicted, but only administratively sanctioned with a fine.

Of course, the new judge can decide to return the process to the prosecutor's office to eliminate violations, as Borislavova's defense insisted on in April. The defense argues that Borislavova was investigated even before her parliamentary immunity was requested. According to the first judge in the case, it cannot be assumed that the investigation was initially directed at Lena Borislavova. It was initiated under one article of the Criminal Code, and Borislavova was charged under another.

Even if a violation had been committed, if the investigation had begun while Borislavova was immune, this violation would not have been remedied, since the investigation could not be restarted from the beginning, the court argued in April.

Borislava is accused of knowingly using, in May 2021, two acts of false private documents, which were made to appear to have been signed by members of the association "Let's Save Coral", when in fact they were not. The indictment against her was filed immediately after she waived her immunity and was charged. The documents in question were used before the Registry Agency to prove that the legal relationship between Kiril Petkov and the "Let's Save Coral" Association had been terminated.
