The purpose of the changes is not to disincentivize potential candidates to accept, as without the legal changes they would lose their positions once they complete their duties as caretaker prime minister. This is what he said in the show "The Day Live" on Nova News, the former constitutional judge Blagovest Punev on the occasion of the extraordinary session of the parliament convened tomorrow with one point – the final adoption of the amendments to the BNB Law introduced by GERB and DPS. The goal is for Dimitar Glavchev, who has been designated as caretaker prime minister, to take over the post, because until now this possibility did not exist.
Until now, it was written in the law that the governor and deputy governors cannot carry out any activity other than teaching or as members of the bodies of companies in which the BNB participates, or of international organizations related to its activity. With the changes, the holding of the position of caretaker prime minister is added to these exceptions. If one of the bank chiefs takes this post, he is allowed to go on unpaid annual leave while exercising the functions of prime minister. The aim is that the same person can then return to his post at the BNB. The same bill makes changes to the Law on the Audit Chamber and the Law on the Ombudsman. The same possibility is provided for the Head of the Audit Office and the Ombudsman and their deputies - to exceptionally fulfill the position of acting Prime Minister, as well as to go on unpaid annual leave while heading an acting government, so that they can subsequently return to their previous positions your posts.
Dimitar Glavchev, nominated for prime minister, has a known conflict of interest, as the activity of the Audit Chamber affects the appropriate spending of public finances. The president of this institution, as the head of the executive power, will dispose of public finances. The issue is problematic, it could be brought before the Constitutional Court, Punev said.
Nominations will be made after talks with the parties, but he will take responsibility for his ministerial decisions and the president will be required to issue a decree appointing the caretaker government, i.e. his actions are under bound competence. And under the previous situation, it was the opposite, the president was the head of the executive power, we were becoming a super-presidential republic, the former constitutional judge pointed out.
In the current situation, the president remains in his post, and he will have the opportunity to control the executive power, he added.
In his words, the caretaker government will work as a full-fledged cabinet.
Regarding the constitutional changes in their judicial reform part, several things are radical and new. The main thing is that the chief prosecutor is no longer at the top of the subordinate pyramid, as before, said Blagovest Punev.
He noted that what has been done in the past nine months for judicial reform is enough, the question is how it will be implemented.
