The Mayor of Parvomay Nikolay Mitkov has committed a gross violation of the Public Procurement Act, writes big5.bg, in connection with the repair of municipal road PDV 1210/III-667/Parvomay – Karadzhalovo-Skobelevo-Stalevo-Yabylkovo.

In a gross violation of the Public Procurement Act, Mitkov ranked the company that offered the highest price for the municipal road in first place, even after decisions of the Commission for Protection of Competition /CPC/ and the Supreme Administrative Court /SAC/.

In addition, the mayor has twice failed to comply with a regulation of the Regional Inspectorate for Environment, Water and Water and has been sanctioned with two separate the act.

The first was issued for failure to comply with a regulation ordering the cleaning of contaminated areas near the village of Tatarevo. However, no action was taken by the end of the statutory deadline - April 15, the control body says, which constitutes a violation of the Environmental Protection Act.

The other act was drawn up 10 days later and is for Mitkov not taking measures against new cases of unregulated waste disposal in Parvomaysko.

According to the Waste Management Act, a mayor of a municipality is fined from 3,000 to 10,000 leva if he fails to take measures to prevent the disposal of waste in unauthorized places and/or the creation of illegal landfills.

It is obvious that Mitkov prefers to pay his fines.

What is the chronology of the case with the so-called “golden“ municipal road, according to the investigation of big5.bg:

By Decision No. F581669 of 23.10.2024, Nikolay Mitkov – Mayor of Parvomay Municipality, on the basis of Art. 73, para. 1 of the Public Procurement Act /PPA/, has opened a public procurement with the subject: “Rehabilitation of municipal road PDV 1210/III-667/Parvomay &ndquo; Karadzhalovo-border of the municipality (Parvomay-Dimitrovgrad)-Skobelevo-Stalevo-Yabylkovo/HKV1009/-section from km 3+440 to km 8+147“, which is published in the Register of Public Procurement of the Public Procurement Agency under No. 00646-2024-0020.

The municipal road is in a deplorable state of repair and has not been repaired for more than 35 years. It is a connecting road between two neighboring municipalities - Dimitrovgrad and Parvomay, passing through the village of Karadzhalovo - Parvomay Municipality and the villages of Skobelevo, Stalevo, Yabalkovo and Krum - Dimitrovgrad Municipality.

The entire road connecting the two municipalities is 35 km long and only 4.5 km between the villages of Karadzhalovo and Parvomay is impassable. This requires traffic between the two municipalities to be carried out via bypass routes, which extends the distance from 10 to 20 km. It is also impossible to move people and goods between the five villages.

The road in question is also an alternative parallel transport corridor of the Motorway „Maritsa“ /north of the road/ and first-class republican road I-8 /south of the road/, which is currently with limited traffic and temporary organization due to repair activities.

Over the years, numerous signals have been received in both municipalities about the condition of the road and the impossibility of passing through it.

A total of 6 (six) offers were submitted within the deadline given by the Municipality (until 23:59 on 25.11.2024). Most of the companies have proven qualities and capabilities to carry out the repairs qualitatively and on time. These are the companies „Groma hold“ EOOD, „VDH“ AD, „Road engineering“ EOOD, „Stor invest“ AD, „Parsek group“ EOOD and „Via construct group“ EOOD.

Before the first ranking, however, the Municipality of Parvomay excluded “Groma Hold“ EOOD and “Patengineering“ EOOD from participation, due to excessively low prices and deadlines for implementation.

With the decision of the mayor Nikolay Mitkov for the selection of a contractor No. D41281439/04.02.2025, the company “Parsek Group“ EOOD, which had given the highest price, was announced. “VDH“ AD and “Stor Invest“ AD were not allowed to rank at all on the grounds that “the technical proposal did not meet the requirements of the contracting authority“.

On the basis of a complaint filed, with Decision No. 411/17.04.2025 of the CPC, which was confirmed with Decision No. 7440/07.07.2025 of the Supreme Administrative Court under adm. e. No. 5184/2025, decision No. D41281439/04.02.2025 of the Mayor of Parvomay Municipality was annulled.

With the above decisions, both the CPC and the SAC accept that the technical proposal meets the requirements of the contracting authority. In view of the circumstances established by the decision-making bodies, Decision No. D41281439/04.02.2025 of the Contracting Authority for the selection of a contractor has been annulled, and the procedure has been returned to the stage of consideration of the technical proposals with explicit instructions regarding the submitted proposals for implementation.

After the resumption of the work of the commission at the Municipality of Parvomay, the same, in violation of the decisions of the CPC and the SAC, again proposes that the same companies not be allowed to be classified, again with the same reason: “the technical proposal does not meet the requirements of the contracting authority. the requirements of the contracting authority“.

By decision of the mayor of Parvomay Municipality No. D48165586/11.09.2025, “Parsek Group“ EOOD was again announced as the contractor with almost the highest price.

The decision on the procedure will most likely be appealed again before the CPC, then before the Supreme Administrative Court and so on until the indefinite future - at the expense of the residents of the municipalities of Parvomay and Dimitrovgrad.

The question logically arises: How long will such violations of procedures and playing games between the contracting authority and the contractor be the reason for a municipal road to continue not being repaired? A road that is impassable, that has not been fundamentally repaired and does not serve for communication and transport access for primary needs - such as ambulances, fire brigades, buses and others.
