Borislav Tsekov: If Radev wants to blame the change in the cabinet, it will lead to a deepening of the chaos

The president is faced with two clear alternatives - either to sign the decree on the changes, or to release the acting prime minister and the entire government. In this situation, the second would be a rather extravagant act, commented the professor of constitutional law

If acting Prime Minister Dimitar Glavchev resigns, there will be no new date for the elections, as the presidential decree has already been issued. And changing ministers every day, this cannot affect the date of the elections. This is what he said in "Day Live" according to NovaNews, the professor of constitutional law Assoc. Borislav Tsekov, quoted by novini.bg..
As the new version is written in the constitutional regulation, the president acts according to the so-called competence tied to the Prime Minister, i.e. must confirm his decision for changes in the government. The dialogue between them may lead to another type of decision, but if the prime minister is adamant about this change, the president is faced with two clear alternatives - either to sign the decree on the changes, or to dismiss the caretaker prime minister and the entire government. In this situation, the second would be a rather extravagant act, Associate Professor Tsekov stated.

There is no need to spare criticism of these changes, but together with that we need to find out the answer to the question of why the foreign minister challenges the president to go to the embrasure and the entire presidential army to defend the minister, he added .

According to him, the constitutional changes do not have a clearly specified term in which the head of state must sign or refuse to sign the decree on the cabinet changes.
If the president wants to blame this change, it will only lead to a deepening of the chaos, emphasized the professor of constitutional law.

In response to a question, he explained that there absolutely cannot be a vote of no confidence against a caretaker government. The National Assembly cannot vote a vote of no confidence in this government because it did not elect it, Assoc. Prof. Tsekov noted.

He also specified that if it comes to the point where acting Prime Minister Dimitar Glavchev resigns, there will be a procedure for forming a new official cabinet.
