Acting Prosecutor General Borislav Sarafov sent a letter to the Speaker of the 51st National Assembly Natalia Kiselova regarding the immunities of six MPs, the removal of which was requested in February 2025. The letter states that at present the Prosecutor's Office of the Republic of Bulgaria (PRB) has not received information about permission or refusal to grant permission to initiate criminal prosecution against them on the basis of the Constitution of the Republic of Bulgaria and the Rules of Procedure and Activities of the Parliament.
On February 4, 2025, repeated requests were submitted to the National Assembly to remove the immunities of MPs J. Ibryamov and M. Rangelov in two separate investigations. On February 27, 2025 The parliament was approached with requests for permission to conduct criminal prosecution against four more members of parliament - Y. Todorov, I. Chorbov, S. Krumov and N. Dimitrov, with the aim of bringing them as defendants for a series of crimes committed in front of the building of the European Commission Representation in Bulgaria on 22.02.2025.
The letter from the Prosecutor General emphasizes that the Code of Criminal Procedure (Art. 22, para. 2) introduces an obligation for the prosecutor and the investigative bodies to ensure the conduct of pre-trial proceedings within the procedural deadlines provided for by law, and the provision of Art. 203 of the Code of Criminal Procedure requires the investigative bodies to take all measures to ensure a lawful and timely investigation. Moreover, with regard to M. Rangelov, on 07.04.2025, another request was submitted to lift his immunity. This time it is due to new pre-trial proceedings related to a crime under Art. 3046, para. 1, in conjunction with Art. 20, para, 2, in conjunction with Para. 1 of the Criminal Code - requesting and accepting a gift in order to exert influence in the conduct and awarding of two public procurement contracts in schools in the town of Cherven Bryag and in the town of Koynare.
Borislav Sarafov expects the National Assembly to provide the Prosecutor's Office with information on the actions taken in accordance with the Rules of Procedure for the Organization and Activities of the National Assembly in connection with the submitted requests for permission to initiate criminal prosecutions.
The continuation of already initiated criminal cases and/or the initiation of criminal prosecution against persons with immunity under Art. 70 of the Constitution is possible only with the permission of the National Assembly or with the written consent of the People's Representative.
