Yanaki Stoilov: I am concerned that there is more talk of judicial reform than actual action - 1

The change in the Constitution was carried out by the people's representatives from three parliamentary groups, who, in an effort to realize their will, accepted this change. It is the most comprehensive compared to the previous ones, which only affected the judiciary. This is what he commented in the program "Hello, Bulgaria" on NOVA the constitutional judge Yanaki Stoilov.
According to him, a number of issues arise, and some of them the National Assembly has undertaken to solve, such as changing laws to eliminate the incompatibility in holding the positions when electing an acting prime minister.

In his words, the problem remains half. “The question arises how, after these three or four months have passed, the chairman of the Audit Chamber, which is an institution created to control the spending of the state budget, will carry out control through the audits he carries out”, he added.
He specified that the restrictions regarding the people who are on the management board of the BNB come from the European requirements, regardless of what changes will be made in the national legislation.

„The official prime minister is the one who must propose the composition of the draft cabinet and have it approved by the president. With the changes in the Constitution, the president is largely freed from political responsibility for the government appointed by him”, Stoilov specified.

He also commented on the case with the intercession of two parliaments. “For a period of several weeks, we will have not 240, but 480 people's representatives. This is the result of the accepted changes. The People's Representative becomes such by virtue of the vote of the citizens, that is, the moment when the elections were held, after they were recognized as regular. He begins to exercise his powers at a slightly later moment when he takes the oath, because taking the oath is a prerequisite for him to exercise his rights as a representative of the people, but he is a deputy, not by virtue of the oath, but because of the vote he received from the citizens”, explained Stoilov.

According to him, the caretaker government, which is to be appointed, will have the same powers as the regular one elected by the parliament, but it should mainly deal with the conduct of the elections and conduct a fair and free vote. /p>

Stoilov also commented on the judicial reform. “I am much more concerned that the talk of judicial reform is more than the actual actions,", he also said. According to him, no real results are achieved to clarify the important cases.
