The Constitutional Court is obliged to file a case. The dispute will now be whether the head of state's request is admissible in its entirety or whether his requests will be partially allowed, since he is making practically two requests in one request - one for the interpretation of a constitutional text, and the other a request for the declaration of nullity of the order that I issued. In my opinion, the Constitutional Court will partially allow the president's request. This was stated by the Speaker of Parliament Natalia Kiselova to BNT.
On Friday, President Radev referred the matter to the Constitutional Court due to Kiselova's refusal to submit his proposal for a referendum on the euro for consideration by the parliament.
"I think that there will not be the expected result, since the reasons state that the Speaker of the National Assembly has powers that are exhaustively listed at the constitutional level. The Constitution has provided that there is a Regulation on the organization and activities of the National Assembly. The Regulation gives the Speaker 17 powers. In addition to these, other laws also provide for powers for the Speaker, I do not think that this is correctly formulated as a reading of the constitutional text," Kiselova also commented, BTA reported.
She pointed out that there is a dispute in legal circles about how to proceed and at what point the possibility of requesting a national referendum is terminated. Since the opinions are divergent, in this way the Constitutional Court, by its act, ruling on whether or not to allow the president's request, will finally put an end to the dispute, the Speaker of Parliament added.
When asked that the president's reasons also contain a text that the act prevents the guaranteed participation of citizens in state power - the sovereign's right to speak out, Kiselova replied that this is the subject of the question. With regard to the issue of the euro, this opportunity ended at the latest at the time when the government requested the extraordinary report from the European Central Bank and the European Commission, she pointed out.
On May 13, the Speaker of the National Assembly Natalia Kiselova issued an order, by which she returned as inadmissible the proposal of President Rumen Radev with a request to hold a national referendum. According to Kiselova, the proposal of the head of state and the reasons for it do not comply with the Reasons and Disposition of Decision No. 3 of the Constitutional Court of 2024 under case number 13/2023. The request itself was submitted to the registry of the National Assembly a day earlier, and the head of state announced that he would address the deputies with a request to consider the proposal for a referendum on the euro in a special statement on May 9.
