The Anti-Corruption Commission in its current form has existed since 2023. For more than a year and a half, the legislative body (ed. - parliament), which is supposed to elect the members of this commission, has been in a state of delay. In 2023, there was an artificial division of the old mega-commission, but it so happened that the members of the current commission participate in both artificially divided commissions. There is a decision of the Sofia Administrative Court, which states that in its current composition, the decisions of the Anti-Corruption Commission are null and void, because the composition of the commission does not comply with the law. The members of the Anti-Corruption Commission were not elected according to the rules of the law. This was announced to Lili Marinkova in the studio “FACTS“ and the program “Conversation“ by judge Kalin Kalpakchiev.
“This, with the expired mandates, applies to both the Supreme Judicial Council and the Inspectorate at the SJC. This is one of the symptoms of the general breakdown of democratic institutions. I was a member of the SJC, but even then the council did not inspire confidence that it was an independent body. This is not my observation, but that of dozens of people. Even today, it continues to be repeated during the procedures for electing members of the SJC that the very structure of the SJC, as provided for in the Constitution, is not good, because there is a political presence, a political quota inside,“ the judge added.
