Former special prosecutor Jack Smith, who led legal proceedings against Trump, is being investigated

He is suspected of violating the Hatch Act, which prohibits government officials from using their official powers to influence the outcome of the election

The Office of the Special Counsel, an independent federal agency of the United States, has launched an investigation into former special prosecutor Jack Smith, who led legal proceedings against the current US leader Donald Trump, the New York Post reported..

Before resigning in January 2025, Smith was involved in cases involving allegations of improper storage of classified documents by Trump, as well as his alleged attempt in January 2021 to maintain his power despite his defeat in the presidential election. As a result, both investigations against Trump were dropped.

According to the New York Post, Smith is suspected of violating the Act “Hatch“, which prohibits government officials, except for the president, vice president and senior administration officials, from using their official powers to influence the outcome of the election, including speaking out in support of candidates.

The investigation was initiated by Senator Tom Cotton (Republican of Arkansas), who considered Smith's activities to be interference in the 2024 election and asked the Office of the Special Counsel to open an investigation. “Jack Smith's legal activities were a tool of the Biden and Harris campaigns“, Cotton is convinced. - Many of Smith's actions had no other justification than an attempt to influence the 2024 election, which violates federal law.“

Earlier, ABC News reported that US Attorney General Pam Bondi had fired at least 20 people who helped Smith conduct investigations against Trump. Among those fired are both prosecutors and aides who played no significant role in the proceedings. Their removal from office was facilitated by the activities of a special task force created by Bondi in February. Its employees were supposed to analyze the investigations against Trump for politicized motives.
