Filip Dimitrov: The Constitutional Court did not cancel the judicial reform - 1

"No, the Constitutional Court did not cancel the judicial reform. He canceled parts of it and specifically two – that the chief prosecutor be reduced to the administrative head of the Supreme Prosecutor's Office and that two councils (Prosecutor and Judge – note ed.) be formed instead of one. This has been cancelled. I really wonder how much you must hate your country and its people to tell all these stories.“. This was explained in the studio of “This Saturday” the constitutional judge and former Prime Minister Filip Dimitrov.

„Limiting the rights of the prosecutor's office on the possibility to attack administrative acts was confirmed, which was a big problem because it could interfere and interfere in many things – this was thought to be bad. The Constitutional Court confirmed the investigative mechanism against the Prosecutor General. The SC confirmed the possibility to appeal to a court, i.e. to introduce judicial review in case of refusal. We also confirmed one more thing – the possibility for the court to terminate the case if there is an obvious lack of grounds for prosecution”, added Philip Dimitrov.

„I really wonder how much you must hate your country and its people to tell all these stories. Things can be interpreted differently. There is no reason to claim that the judiciary is dominated by the prosecution. Bulgaria's big problem is the extreme malice with which these things are spoken about. The way in which bombastic and false statements are constantly being thrown, which should make the Bulgarian citizen feel crushed, defeated, humiliated and to instill hostility that is not in the interest of the country”, explained the constitutional judge.

In his words, the decisions in various cases concerning the judicial system came out on the same day in order to see “the completeness of the whole structure”.

According to him, there was no recommendation for reducing the chief prosecutor to the administrative head of the Supreme Prosecutor's Office.

„As the Venice Commission pointed out, the very placement of the chief prosecutor in this role represents a violation of the very principle of the structure of the prosecutor's office and its place among the other bodies under a constitutional model such as Bulgaria and Italy. This is something that affects essential characteristics of the institution”, commented Dimitrov.
