It is not a good sign that the CEC delays the registration of one participant in the elections for such a long time. This was stated before the BNR by the former chairman of the Commission, Adv. Alexander Andreev regarding the problem of registering the two factions of the DPS for the upcoming early elections.
"Everyone expects the CEC to eventually make its decision regarding the registration or not of the two coalitions. This question has been open for a long time. However, September 11 is the deadline for registration of parties and coalitions. If the registration of any of the coalitions is refused, it has an additional period of up to 35 days before the elections. The work of the Commission does not give a good sign from this point of view – so long as to delay the registration of one participant in the elections. The CEC should meet today and answer the question of which of the two and whether it will register them or not, so that from now on the participants can take the appropriate actions to defend their position," he commented.
The CEC is a collective body that makes its decisions with 2/3 of those present at the meeting, Andreev reminded in the program "Before all". In the absence of such a majority in the Commission – this is a rejection decision, he pointed out and explained: "With a rejection decision, the proposed draft decision itself, which was discussed within the CEC meeting, is rejected. It is also a decision with a number and is subject to appeal to YOU".
"In themselves, the instructions are part of the overall registration procedure and it would follow that the final act of registration or refusal of such should be subject to independent appeal, and not the intermediate actions that the CEC performs within the framework of this procedure", the expert also noted.
"Directions given in a negative aspect, i.e. for someone to be taken out of a particular coalition, whether it is DPS or another political party, is something that in itself I believe should not be right in terms of wanting to take out a political party strength", Alexander Andreev expressed his opinion, noting, however, that there is a lack of sufficient information and reasons that led to this decision. According to him, the instructions are expected to give positive guidelines on how to supplement or correct documents so that they can be related to the law.
