Adv. Velislav Velichkov: After the elections, Sarafov's candidacy may be subject to various agreements - 1

I do not at all rule out the possibility of the candidacy of Borislav Sarafov, the only candidate, being “sold” on the political field. What I mean – three people from the prosecutor's collegium of the SJC nominated Borislav Sarafov. This was commented on bTV Radio by lawyer Velislav Velichkov from the "Justice for Everyone" Initiative, quoted by novini.bg. Last night, the organization held a protest against the promotion of Sarafov, who is the only candidate for the post of chief prosecutor, and demanded the termination of the procedure.

"Six others, since every three had the right to make a nomination, remained a pass on this matter. Unlike the elevation of Ivan Geshev, when all of the prosecutor's collegium, led by the then chief prosecutor Sotir Tsatsarov, signed this candidacy and defended it, now six people from the prosecutor's collegium are silent. Probably this silence too has been ordered. After the elections, there will be very difficult political negotiations for the composition of a new government and for the formation of a parliamentary majority. As well as for the continuation of the judicial reform in one way or another, because at the moment, after the decision of the Supreme Court, it is in the hypothesis of that parable about a clan, a clan, not a clan.

In the hypothesis of these negotiations, the candidacy of Borislav Sarafov until January 16, note that this is more than 2 and a half months after the elections, at least 2 months after the formation of the parliament, may be subject to various agreements.

strong> And if some agreement is reached in one direction or another, it may turn out that he will not receive the necessary 13 votes at the SJC plenum on January 16, and so the procedure will be terminated, a new composition of the SJC will be elected, he will also be part of the deal though, or at least his parliamentary quota, which is half his electorate, and then it can be moved on to another candidate. But this candidate will also be subject to a political deal and will fall into political dependence even before his election, because he will be a product of those deals from the shadow side of politics, because they will not even happen in public. So Borislav Sarafov himself cannot be sure that even though he has been promoted, he will become the chief prosecutor or that his wish, stated in front of a large media, that he does not want to be the chief prosecutor, can come true.< /p>

He himself has another move – by October 24, he must submit his concept for the management of the prosecution as the only candidate. If he does not submit it, his candidacy is automatically dropped and the procedure is terminated. The awkward thing for him to make this decision is that the 24th is 3 days before election day and he will not be aware of the political distribution of forces after the election results are announced. So, I rather expect that he will remain a candidate. And whether he will become the chief prosecutor, that will not be decided by him, nor by those who are expected to vote. And they still don't know how they will vote in January. It will depend on the political will of a certain clique or a certain person, and that is the worst thing about the judicial system.

This is the total political dependence that threatens not only the prosecutor's office, but also the top of the judiciary, since the same agreements will probably play out in the procedure for the chairman of the Supreme Administrative Court."

„ This composition of the SJC, with an expired mandate and with compromised public trust, cannot choose a new chief prosecutor for the next 5 or as they returned the old text – 7 years, also for the chairman of the Supreme Administrative Court, Velichkov also said.
