New Plenum of the SJC and again no candidates for chief prosecutor - 1

No candidates for chief prosecutor and at the second meeting of the Plenum of the Supreme Judicial Council, at which nominations may be made.

The next possible dates for nominations are October 3 and 10.

According to the Judiciary Law, proposals may be made by at least three members of the Prosecutor's College and the Minister of Justice. The incumbent Maria Pavlova has already announced that she will not have her own nomination for the position.

According to Art. 173 of the Civil Code, nominations for the chief prosecutor can be made by no less than three of the members of the SC of the SJC, as well as the Minister of Justice in the four consecutive meetings following the meeting at which the decision to open the procedure was adopted. And that happened on September 12. The election is scheduled for January 16.

By law, candidates for Attorney General must have at least 12 years of experience, as well as meet the following requirements: ability to uphold and enforce a high ethical standard; high professional competence: possess in-depth knowledge in the field of law, extensive practical experience in the relevant field of law, managerial and administrative skills, outstanding analytical abilities; pronounced independence, will to enforce legality, decisiveness in the performance of official duties and contributing to the establishment of the rule of law; to have developed skills for working in a team, for motivating colleagues, for seeking and taking responsibility.

We remind you that yesterday the PP-DB threatened to file a complaint with the Constitutional Court if this panel of the SJC issues a nomination for a new chief prosecutor. This was stated by MP from PP-DB Lena Borislavova on the air of "Nova News".

In her words, the resumed procedure for choosing a new prosecutor number one is illegitimate. She clarified that if 48 signatures of deputies are collected, a request for interpretation by the Supreme Court can be submitted and thus the procedure can be stopped at least until the magistrates pronounce.

If there are indeed prosecutors who decide to participate in this procedure, we will collect signatures and submit a request to the Supreme Court for the interpretation of the provisions related to whether this SJC has the right to elect a new chief prosecutor for 7 years, Lena pointed out Borislavova.
