The gathered so far, the facts surrounding the one-and-a-half-year-old child who was shot yesterday in Vratsa indicate that it was a ridiculous incident in which two children were involved, Vratsa district prosecutor Vladimir Sirakov told journalists, quoted by BTA.
In his words, the pre-trial proceedings are under Art. 115, in conjunction with Art. 18, which is a relatively heavy text - attempted murder.
„For me, the legal qualification is not quite accurate. In view of the evidence collected so far, it is rather a matter of causing, at the moment, serious bodily injury due to carelessness," said Sirakov and added that "colleagues from RU - Vratsa have taken out reinsurance, in view of the situation".< /p>
What has been established from the interviews conducted so far is that the reckless shooting was carried out by an 11-year-old relative of the injured child, who is not criminally responsible.
It has been established that in March 2021, the grandfather of the injured child purchased an air rifle, brand “Kral“, 5.5 caliber, which shoots “cups” (ball type).
Spazil is a registration mode and has registered it in RU - Vratsa. According to the District Prosecutor, yesterday the grandfather of the injured child took out the weapon, his purpose was to shoot at magpies, he loaded and unloaded the weapon several times.
At some point he sent his 11-year-old son to buy ice cream from the store. While the boy was gone, he reloaded the rifle. When his son returned, the rifle was on the table. At the same moment, people arrived who wanted to buy lambs, the grandfather and grandmother stood up to meet them, the mother also withdrew her attention from the little child who was walking.
He grabbed the rifle by the barrel and began to pull it, and the eleven-year-old, in an effort to prevent the weapon from falling, grabbed it on the other side by the butt and inadvertently pulled the trigger. When the shot was fired, one of the bullets hit the area of the little child's face, above the eyebrow.
„ Such is the factology. This 11-year-old didn't know the gun was loaded because he was out buying ice cream. And that's why there is no way to establish an intention to commit such an act”, pointed out Vladimir Sirakov.
According to him, it is necessary to make legislative changes to regulate the legal status of this type of weapon, as it is currently not clarified.
„Here you see that a situation with serious bodily injury can occur and the use of such an air rifle should not be underestimated,” Sirakov pointed out.
