With a new indictment in the court in Kardzhali tomorrow begins the case for the death of the 6-month-old child in the accident near Zagorsko, rodopi24.com reported.
The father of the deceased Ejrin - Yusein Ahmed, and the former politician Lutvi Mestan will be brought before Themis again. They are charged with causing death by negligence.
The District Court in Kardzhali has scheduled the disposition hearing for May 13 - Monday, at 10:00 a.m.
The case was initiated by the District Prosecutor's Office again – Kardzhali indictment, after, by a ruling from a dispositional hearing held on 23.11.2023, a panel of the court terminated the court proceedings in general criminal case No. 1/2021 and returned it to the prosecutor for the removal of removable persons admitted to the pre-trial proceedings substantial procedural violations that led to limitation of the procedural rights of the accused.
The disaster happened on April 14, 2019 on the main road Kardjali - “Makaza” when Lyutvi Mestan tried to join the traffic from the junction for the village of Zagorsko. Then there was a collision with the Ahmed family's car. Little Ejrin died in the accident.
The defendant Yussein Ahmed was brought to court for the fact that on 14.04.2019, while driving a car, he violated the rules of the road, by himself and in the conditions of independent complicity with L.M. he committed a road traffic accident, in as a result of which he carelessly caused the death of one person – crime under Art. 343, para. 1, b. “in“ in conjunction with Art. 342, para. 1, proposition 3 of the Criminal Code.
The defendant Lyutvi Mestan has been brought to court for violating the traffic rules on 14/04/2019 while driving a car, as alone and in the conditions of independent complicity with Yu.A. committed a traffic accident, as a result of which he carelessly caused the death of a person - a crime under Art. 343, para. 1, b. “in“ in conjunction with Art. 342, para. 1, proposition 3 of the Criminal Code.
Lyutvi Mestan is a former politician from the SDS, DPS and DOST. He last led the DOST party, but after being discredited by the ruling power in Ankara, DOST exists only on paper. Mestan's most loyal associates returned to the DPS, even one of his deputies – Husein Hafazov, has a real chance of becoming a deputy in the 50th National Assembly.
