The fact is that when you sit behind the wheel, you should approach it with the necessary responsibility, regardless of what the company car is and what functions it performs. Traffic rules are the same for everyone and must be followed. There is no legal hypothesis in which laws can be ignored and disobeyed," said lawyer Dimitar Markovski in the studio of "The Day ON AIR".
In his words, the driver of the NSO car would have received a lighter sentence, because his right of way was taken away.
"First of all, we must have the result of a prepared auto-technical conclusion, which will establish what the speed of movement of the NSO official car is. If it turns out that this speed has been exceeded, then the driver of the car must take the appropriate criminal responsibility. It will be severely mitigated on the basis that the elderly man and his wife who were injured have taken away the advantage. It will inevitably reflect on the criminal responsibility of the driver of the NSO", added Markovski on Bulgaria ON AIR.
The lawyer is adamant that before it is known for sure who is guilty, there must be an examination.
"The auto experts will answer if the speed allowed for this road section was driven, whether the impact was preventable. A very ridiculous incident, unfortunately, with a deceased person. The preparation of the technical conclusion will give definite answers as to who has what fault and to what extent he should bear it. There is no way there can be an instigator in the conditions of a careless act", commented the guest.
He added that moral responsibility lies in every single law.
"In the law, in every legal norm, there is a minimum of morality, without which no society can do. That is, this should not be done. Moral responsibility must be assessed in terms of who did what in this situation shortly before the accident occurred, and if someone in any way contributed to this, he must personally bear this moral responsibility," the lawyer added.
