An internal party problem cannot be brought into the public space, and that too at an extremely important moment. Parties do not take part in elections by force.

This is what lawyer Valya Gigova commented in an interview for BNR in connection with the tension surrounding the appearance of the various wings of the DPS in the upcoming early elections.

"Neither the CEC nor the court can be expected to make a choice as to whether the party will participate in the elections independently and through which coalition."

According to her, "there is nothing fatal like not being able to understand each other" and "there will once be elections without a single political force" to make it clear that "it cannot be done that way".

The principle of the first by right cannot apply in the present case, explained lawyer Gigova.

In her words, the CEC has no way of choosing which coalition to register, and we cannot ask this from an independent state body.

"If I step into their shoes, I will do what they did – they do not register either the party or any of the coalitions. The same issue is currently before the Supreme Court, which has to rule on exactly the same issue, only with regard to commercial companies. In the case of two managers who jointly and severally represent the legal entity, whether the court can choose which of the wills should be the legal entity's statement. Well, the court has no choice."

"To understand who will make the statements, who will make these statements and not to bring turmoil to society and the legal order,", she urged.

One composition should look at the appeals of both the one and the other coalition, Valya Gigova believes. She expressed concern that it might not turn out that "whoever made the last declaration of will will have the right".

The basis of law is reason - the exact application of the law, so as not to raise doubts that the law is the same for everyone, she pointed out.

The authority of the CEC and the court will not suffer from the incident with the DPS, Valya Gigova emphasized in the program "Before all". According to her, there can be no doubts about the independence of the CEC in view of its construction, and the court has the last word because it is "part of the state system that corrects all other mistakes".
