From the beginning of May, changes in the Tax Procedure Code came into force. Until now, when confessing a real estate transaction, declarations of the absence of outstanding public obligations were presented. This document will no longer need to be presented by citizens, as the verification will be carried out by the electronic notary who confesses it or, in certain cases, by a registration judge.

Real estate agents commented on the change as an additional burden for them, but mostly for the notaries, who will become “tax collectors at the expense of the state”.

What will happen in practice? The parties to a home purchase transaction, for example, make an appointment with the notary. They show up. But there it is established that one of the parties has obligations to the state. There are two options: one is to repay them immediately, and the second – booking a new appointment with a notary, which will require “the creation of a new organization for the transaction”, brokers explain.

The mediators will be of maximum assistance to the parties to the transaction in order to check on the NRA website whether the parties have obligations and to clear them in a timely manner, even before going to the notary to confess the transaction.
