Appellate Court – Plovdiv overturned the decision of the Plovdiv District Court, by which a measure was taken to restrain “under the supervision of the parent“ against accusations for the death of his mother LB and determined a measure “under the supervision of an inspector from the Children's Pedagogical Room”, BTA reported, referring to the press center of the Palace of Justice in Plovdiv.
L. B., aged 14, is accused of causing the death of his mother on October 13 at his home in Plovdiv. The case was initiated in the Court of Appeal following a protest by the prosecution against the remand measure taken by the first instance court. Due to the minor of the accused, the court hearing took place behind closed doors.
Appellate judges believe that from the evidence collected so far, there is no reasoned assumption of the boy's complicity in the crime of which he is accused – for the intentional murder of his mother, considering that there is evidence of the existence of a well-founded suspicion of complicity on the part of the accused to have committed an act under Art. 124 of the Criminal Code, namely causing death through negligence as a result of intentional bodily harm.
Appellate judges share, like their colleagues from the District Court, that there is no danger that LB will commit a crime or abscond with a lighter sentence. He lives with his father and goes to school. The court considers that the father cannot exercise effective control over his son, and therefore the most adequate measure in this case is “under the supervision of an inspector from the Children's Pedagogical Room”. During the court session, the parent and inspector from the Children's Pedagogical Room were present in the courtroom.
The determination of the court is final.
