"Radev violated the Constitution! IMPEACHMENT!". This is what the Atlantic Council of Bulgaria called for on its official Facebook page, after yesterday Rumen Radev refused to sign a decree for the appointment of Goritsa Grancharova - Kozhareva's office because Kalin Stoyanov remains in the composition as Minister of the Interior, reported FOCUS.

According to Rumen Radev, this will hinder the holding of fair elections.

Goritsa Kozhareva, however, refused to replace Stoyanov and went to the chief prosecutor to file a report of pressure on her as to who should be interior minister.

"In the Basic Law, it is imperatively stated that the president "upon the proposal of the candidate for interim prime minister, appoints an interim government and schedules new elections within two months."

Appoints, but cannot appoint.

He is obliged to appoint after receiving the proposal from the candidate for acting Prime Minister.

The president is only free to choose who from the list of persons will be acting prime minister, but he has no right of choice regarding the act of appointing the proposed composition of the acting government.

The norm is not dispositive, but imperative.

It is the same as with the promulgation of the laws in the State Gazette after overcoming the presidential vetoes. The president no longer has the right to choose, but is obliged to carry out the action.

"Art. 99

(5) (Amended and supplemented - SG No. 106 of 2023) If no agreement is reached on the formation of a government, the president, after consultation with the parliamentary groups and on the proposal of the candidate for acting prime minister, appoints caretaker government and schedule new elections within two months.

The ex-officio prime minister is appointed from among the chairman of the National Assembly, the governor or deputy governor of the Bulgarian National Bank, the chairman or deputy chairman of the Audit Chamber and the ombudsman or his deputy."
