Traffic police are obliged to report when a car is deregistered

The fine for unpaid insurance has increased from 550 leva to 500 euros

The court overturned a penal decree of the “Traffic Police”, by which a woman was fined, her license was taken away and points were deducted. The sanctions were imposed because she was driving a car that was deregistered ex officio due to an unpaid contribution for “Civil Liability” insurance. In this case, however, the court is categorical - the Traffic Police does not have the right to fine a driver if he has not previously been notified in writing that his car is without valid registration.

The case dates back to December 18 last year, but the injured woman does not want her identity to be revealed. “Police stopped me on the road and said they would take my license because I had forgotten to pay for my “Civil Liability” insurance. My elderly mother was in the car, and she got worried. The next day she was admitted to the hospital because of this. My license was revoked for 6 months, 10 points on my license plate and I was fined 550 leva. Of course, I paid the insurance immediately”, the woman told Nova TV yesterday. Without a license, she was also unemployed, as she could not drive the company car, and her blood sugar spiked from anger.

“You have 14 days after the last installment, in which you are required to renew the insurance. Then the Guarantee Fund submits information to the Traffic Police, which deregisters the car, but from there they have to officially notify you. According to an interpretative decree of the Supreme Court of Cassation and the Supreme Administrative Court from 2022, no sanction is imposed if you do not have such a notification,” explained the woman's lawyer Yavor Cholakov. According to him, the police officers on the road should not have punished the woman, but only notified her so that she could renew her insurance, but they obviously do not know the law.

Cholakov also warned that from April 1, the sanction for unpaid “Civil Liability” insurance is now 1 year of taking a license and the fine (for a more democratic - editor's note) is now 500 euros.
