Six months after the ATV tragedy in Sunny Beach: The accused remains in custody

The Burgas District Court left the detention order of 19-year-old Nikola Burgazliev, accused of the serious ATV accident in Sunny Beach, unchanged. He appealed his permanent arrest. The young man's defenders insisted that Burgazliev be released on bail or with another lighter measure so that he can complete his secondary education, reported "Nova TV".

We recall that on August 14, Nikola Burgazliev, in whose blood traces of marijuana were found after the accident, lost control of the powerful buggy and swept away the family who were moving along the sidewalk. Five people were injured, including 35-year-old Hristina, who died after a month in a coma, and her son - 4-year-old Martin, who survived, but is 100% TELC.

The prosecutor's office announced that the pre-trial proceedings have already ended. It remains for the investigators to write a final statement and for the materials to be submitted to the court to set a date for a pre-trial hearing. Burgazliev's defense, however, is using all legal mechanisms to delay the moment the materials enter the courtroom. Their next move is today, when a change in the detention measure will be requested. So far, the perpetrator has been in permanent custody.

Before the Burgas District Court, Burgazliev stated that he regretted what had happened and insisted that he be given the opportunity to take the upcoming exams.

At the request of the defense, his class teacher was questioned as a witness, who indicated that under the conditions of arrest Burgazliev could not pass the required 19 exams and take the matriculation exam in May. His lawyer Galina Koleva argued the request with the constitutional right to education and stated that the accused was not provided with a real opportunity for education. The defense requested the imposition of a lighter measure of detention - cash bail or house arrest with electronic monitoring.

"We know what the situation is. We are not indifferent to the other side. We express our condolences again to the family of the deceased Chrissy. We are also very sorry for the child. But unfortunately we cannot turn things back. This can happen to anyone. Please, let him be given the opportunity to graduate, that's what he wants”, said Burgazliev's mother Rosa Raleva.

The prosecutor's office determined the complaint as unfounded, pointing out that the accused had been provided with contacts with teachers. District Prosecutor Hristo Kolev said that Burgazliev was allowed to study in custody. The prosecution pointed out the high public danger of the act and recalled that narcotics were found in the driver's blood.

Meanwhile, Burgazliev's classmates gathered in front of the courthouse in his support, as well as his parents.

„The pre-trial proceedings have ended and before the New Year they presented us with the materials, but there is no specific date for the case. Marty is recovering slowly and has a TELK decision of 100% for one year. He goes to a speech therapist and rehabilitation three times a week. So far, the doctors say he is doing well," said the victim's relative, Yulian Zdravkov.

“He should not be free, nor under house arrest,” the man also said.
