"This Supreme Judicial Council (SJC) is outlines as eternal. In just ten days, it will be two years since the mandate of this SJC expired. The Constitutional Court (CC) left it as it was and did not determine in what period it would be illegitimate and would have usurped representative power. The Constitutional Court should interpret the decree itself. A body with an expired mandate cannot have real powers. Maybe in 2030, this SJC will open a procedure for electing the next chief prosecutor".
This was stated by lawyer Velislav Velichkov in the show "The Day ON AIR".
In his words, when you don't want to do a job, you explain the reasons why it can't be done.
"Four or five parliaments did not even open the procedure and did not start nominations of candidates for the parliamentary quota. It is difficult to achieve 160 votes, but if it was set as a mandatory condition before the changes to the Constitution... Parliament can stop the resumed procedure, and the next composition of the SJC will carry out the elections. This bill is with Raya Nazaryan and is not considered by a committee," the lawyer also told Bulgaria ON AIR.
" Sarafov had said two weeks earlier that under no circumstances would he hold the position of chief prosecutor. Suddenly, he was controversially elected by the Prosecution College. The Supreme Judicial Council is also to blame. For two years, he did not open a new procedure for the selection of professional quotas," stressed Adv. Velichkov.
The guest pointed out that everything in the growth of a prosecutor depends on the chief prosecutor and the one who appoints the chief prosecutor.
"The serious candidates are Borislav Sarafov and Maria Pavlova. Whether she opts out or is a clear candidate is not up to her. She is currently seconded to the Ministry of Justice. She showed that she was acting in the interests of the prosecution. Whether Sarafov will be able to prove his loyalty to the new beginning, depends on whether Maria Pavlova will say: There is simply no one and it should be me", believes the lawyer. Velichkov.
He is of the opinion that the country is getting into a huge chaos and if no request is made to the CC and there is no intention of the politicians to stop the procedure, then the citizens will have to stop it.
