„We Continue the Change“ filed two official reports with the Inspectorate of the Supreme Judicial Council regarding significant suspicions of violations of the law, the code of ethics and the principle of impartiality by representatives of the judiciary in the case in which the mayor of Varna Blagomir Kotsev and three other people were arrested. This is stated in an official statement from the formation sent to the media.
The first report is directed against the actions of the prosecutors from the Sofia City Prosecutor's Office Georgi Ivanov and Ahmed Kokoev. It states that with their actions in the pre-trial proceedings, the prosecutors deliberately circumvented the rules of jurisdiction, bringing the defendants from Varna to the Sofia detention center and filing the request for a permanent measure of "detention in custody" with the Sofia City Court, which has no jurisdiction over the case. There are also serious doubts that immediately before the court hearing the prosecutors changed their ruling, adding new elements to it, including the figure of an "unknown defendant" with immunity - a legal construct unknown to Bulgarian law.
The second signal is against the actions of Judge Stoyan Mihov of the Sofia City Court, who considered the request for detention in custody. From “Continuing the Change” We express deep concern that despite all the objections of the defense and the clear rules of the Criminal Procedure Code regarding jurisdiction, Judge Mihov examined the case and rejected the objections without providing convincing reasons. The signal states that there is publicly available information that some of the changes in the prosecutor's decree were made at his direction.
Both signals question the professional competence, impartiality and independence of the magistrates involved, as well as their ethics and commitment to the rule of law.
The Inspectorate of the Supreme Judicial Council, the acting Prosecutor General, the administrative head of the Sofia City Prosecutor's Office and the President of the Sofia City Court have been notified with a request for an urgent inspection and establishment of whether disciplinary violations have been committed that harm the prestige of the judiciary.
„We continue the Change“ will continue to insist on full transparency and accountability of institutions, especially when it comes to actions with serious political consequences.
