The Constitutional Court has ruled in a ruling on the constitutional case regarding the election of the Deputy Chairman of the Court of Accounts, as well as declaring incompatibility for the person Dimitar Glavchev as Chairman of the Court of Accounts, the Constitutional Court reported on its website, quoted by the Bulgarian National Radio. The requests were submitted by the parliamentary group of PP-DB, APS and MECH.
The Court's announcement states that:
"At its session on 16.09.2025, the Constitutional Court ruled in a ruling on constitutional case No. 10/2025 and admitted to consideration on the merits the request of 58 members of parliament from the 51st National Assembly to establish the unconstitutionality of the Decision to elect a Deputy Chairman of the Court of Accounts – Silvia Rusanova Kadreva, adopted by the National Assembly on 16.05.2025 (published in the State Gazette, issue 42 of 2025).
The Constitutional Court rejected the request of the Members of Parliament to establish incompatibility of Dimitar Glavchev in holding the public office of Chairman of the Court of Accounts as inadmissible and terminated the proceedings in this part, since the Court does not have jurisdiction to establish incompatibility of persons holding the office of Chairman of the Court of Accounts.
The Constitutional Court has the authority to establish incompatibility with respect to Members of Parliament on the basis of Art. 72, para. 2 in connection with para. 1, item 3 of the Constitution and with respect to constitutional judges on the basis of Art. 152 of the Constitution in connection with Art. 12, para. 1, item 12 of the Code of Civil Procedure.
The legislator has assigned the authority to establish incompatibility of a person holding the public office of Chairman of the Court of Accounts to the Commission for Combating Corruption – Art. 13, para. 1, item 8 of the Code of Civil Procedure.
The decision was adopted unanimously.
All 12 constitutional judges participated in the meeting.
