Iliyana Yotova is already president, there is no need to take an oath.

This was stated to the Bulgarian National Radio by Prof. Emilia Drumeva, former constitutional judge and former legal secretary to President Rumen Radev, emphasizing that the leading concept related to the presidential institution is the continuity of the functions and the mandate of the office of president: "Not a moment without a head of state"

"Taking an oath would violate continuity and would violate the Constitution. And the Constitution itself does not provide for the participation of the National Assembly, before which an oath is taken, in this hypothesis. Everything happens by virtue of the Constitution".

By the end of Yotova's term, Bulgaria will remain without a vice president, specified Prof. Drumeva.

According to her, the president's consultations on forming a caretaker government could begin as early as next week.

In the program "Horizont for You", Prof. Emilia Drumeva also commented on the case of the document signed by the resigned Prime Minister Rosen Zhelyazkov for the inclusion of Bulgaria in Donald Trump's Peace Council:

"What has been stated today, to ask the Constitutional Court whether the conclusion violates the fundamental provisions of the Constitution, is a construction explicitly provided for in our Constitution and in the previous practice, such cases have occurred and the Constitutional Court has ruled. This ruling must be made before the ratification of the document in parliament. For such an international treaty, ratification is undoubtedly necessary, the Constitution provides for it".

"Hardly", she replied when asked if it would be in Rumen Radev's draft.
