"The refusal of the president to issue a decree for the appointment of an interim government with the proposals of Kozhar's panel fully fits into his powers. The president is not a notary to certify someone else's will,", he said in "The Day Begins" on BNT Prof. Plamen Kirov - former constitutional judge.

"He can refuse to sign the decree and this refusal is not a violation of the Constitution, although other opinions of colleagues are heard. But you know that when there are two lawyers there are at least three different opinions.

The candidate for minister is a political person, adds the constitutionalist. The assessment is given by other politicians, so they give different qualifications based on their interests.

"Some admire a certain choice, while others oppose it. So this is also in the order of things", Prof. Plamen Kirov is convinced.

In his words, this is political speaking that serves certain political interests. Especially since we are on the threshold of early elections. Under the old arrangement, before the amendment of the Constitution, the appointment of a caretaker government and the scheduling of elections "went in a package".

"But after the amendments, the president is no longer the master of the situation in which a caretaker government is broadcast. It is not up to him alone to select the composition of the caretaker government and appoint it. First, that he chooses between positions in the "home book", which turned out to be not particularly full at the moment. In the second place, he can appoint a composition only at the proposal of the candidate for prime minister.

Hypothetically, there is a situation in which it is impossible to appoint a caretaker government, Plamen Kirov believes. Does this mean that there will be no early elections, asks the constitutionalist.

"If we assume the absence of an official government with the impossibility of elections, it seems to me that we are already walking on the razor's edge here, i.e. on the edge of constitutionality".

He is convinced that early elections cannot be postponed for too long.

"We cannot artificially extend the mandate of a parliament that has failed, that cannot produce a government with a simple majority, but count on it to fill the "home book".

Prof. Plamen Kirov believes that the actions of Gorica Grancharova, related to filing a report with the prosecutor's office, are political and nothing will follow from this.
"It seems to me that this is a political cigarette".
