Unfortunately, there is police arbitrariness – the police authorities have to consider whether he can commit a crime, whether he should be detained. In this case, the woman should not be treated as a criminal," Todorov said. According to him, it is publicly known that about 5% of the tests are false positives.
„Antoaneta Borisova can appeal the detention order and can claim non-pecuniary damages, because this stress of being treated like a criminal for 16 hours is not normal”, he believes.
According to Todorov, for such violations, it is enough to revoke the driver's driving license: “If the person is not rioting, is not dangerous, and no other substances were found in the vehicle, why detain him?”, he asked .
