Acting Prosecutor General Borislav Sarafov made a comment to journalists about the requested immunities of MPs after the ceremony for the "Policeman of the Year" awards.
"Keep in mind something important - the Prosecutor General is somewhat in the role of a kind of mailbox. I do what my colleagues from the relevant prosecutor's offices, respectively supervising prosecutors, ask of me," Sarafov said.
"I have a certain period of time in which to assess the justification, I will do it soon, the period has not been specified, the maximum period is one month", he added.
He commented on whether he would request the immunities of other MPs. "Keep in mind that if I do not request immunity when such a thing is requested of me and there are grounds, this means that I fall into a situation of personal concealment, that is, I am blocking the path to criminal prosecution," Sarafov also said.
He stated that the political situation does not suggest a convenient moment to request immunity. He also explained what the possible paths are for the prosecutor's office. "One option is when a specific moment is ripe, then to request immunity, the second option is regardless of whether an investigation has been completed, to put the case "on hold" and "wait" for a suitable convenient moment. I am convinced that there cannot be a convenient moment. The moment must be when the needs of the investigation itself require it," explained Sarafov.
In the words of the acting prosecutor general, requesting immunity does not mean a verdict, but an opportunity to conduct an objective investigation. According to him, the position and personality of the prosecutor general are being overexposed. "First, I have not held this position, it is not known whether I will ever hold it, second, the prosecutor general does not decide all cases, this is not possible," explained Sarafov. According to him, the Prosecutor General does not know all the cases, and has too many other functions in administering the system.
"I can assure everyone that there is no selective justice. A request for immunity means only one thing - the opportunity to conduct an investigation, whether someone is guilty or not, the court decides. Do not see in me a person who will neither stop, nor block, nor tolerate the introduction of immunities", he pointed out.
"The Prosecutor's Office has become the main political chewing gum, if we go back in time we will see that it is actually the cornerstone around which politics in the state revolves, regardless of who the Prosecutor General is, politics revolves around the Prosecutor's Office", Sarafov also said. According to him, the Prosecutor's Office is an institution that tries to be for the benefit of citizens.
We recall that on December 10, the co-chair of "We continue the change" Kiril Petkov submitted to the registry of the 51st National Assembly a waiver of his immunity as a member of parliament. A day earlier, Sarafov requested Petkov's immunity. The reason - an investigation against Petkov for having ordered the arrest of Boyko Borisov, Vladislav Goranov and Sevdelina Arnaudova in violation of his powers.
A few days later, it became clear that the Sofia District Prosecutor's Office (SPO) had proposed to Acting Prosecutor General Borislav Sarafov to request the immunity of Lena Borislavova as a member of parliament from "Continuing Change-Democratic Bulgaria". The investigation is related to proceedings initiated in relation to the association "Let's Preserve Coral". In April, it became clear that the SPO had initiated an investigation in relation to the association "Let's Preserve Coral", ten witnesses were questioned.
