District Court – Rousse took a measure of remand "detention in custody" regarding the 39-year-old S.M., brought in as a defendant for possession with the purpose of distribution of 15.5 grams of heroin, reported FOCUS.
According to the prosecutor's office, the man committed this act on 07.05.2024 in the conditions of a dangerous relapse, after a year ago he served a sentence of 3 years and 6 months of imprisonment under a strict regime for the same type of crime.
District Court – Ruse considered that, in view of the upcoming investigative actions in the case, the only adequate measure against S.M. at the moment is detention in custody. The charge is a serious intentional crime, for which a punishment of 5 to 15 years of imprisonment and a fine of twenty thousand to one hundred thousand BGN is foreseen. According to the court, the evidence in the case requires the conclusion that there is a real danger that the accused will go into hiding to avoid criminal responsibility or commit another crime, given his two previous convictions and the lack of work engagement data.
There are no grounds for the remand measure requested by the defense "House arrest", given the lack of evidence that the accused is the only one who takes care of his child, even more so in view of the above, regarding his criminal record.
The determination of the District Court – Ruse can appeal with a private complaint or protest within three days before the Veliko Tarnovo Court of Appeal.
