President Donald Trump said he is considering revoking the American citizenship of comedian Rosie O'Donnell, the Associated Press reported, quoted by BTA.
However, a Supreme Court decision explicitly prohibits such an action by the government, the agency emphasizes.
"Due to the fact that Rosie O'Donnell is not in the best interest of our Great Country, I am seriously considering revoking her citizenship," Trump wrote in a post on social networks. He added that O'Donnell, who moved to Ireland in January, should stay in Ireland "if they want her."
Trump and O'Donnell have been publicly criticizing each other for years. In recent days, the actress has condemned Trump and his administration's actions, including the signing of a bill that provides for numerous tax breaks and spending cuts, which was supported by the Republican Party.
Earlier, Trump threatened to revoke the citizenship of billionaire Elon Musk, with whom he also entered into a dispute over the bill.
However, the situation with O'Donnell is different from that of Musk, who was born in South Africa, because she was born in the United States and has a constitutional right to American citizenship, the AP specifies.
Amanda Frost, a law professor at the University of Virginia School of Law, notes that the U.S. Supreme Court ruled in a 1967 case that the Fourteenth Amendment to the Constitution does not allow the government to revoke citizenship.
"The president does not have the authority to revoke the citizenship of a person born in the United States. citizen," Frost explained. "In short, we are a nation founded on the principle that the people elect the government; the government cannot elect the people," she added.
O'Donnell moved to Ireland after Trump won a second term as president. She said she is in the process of obtaining Irish citizenship based on her family background.
