Bulgaria is without a chief prosecutor and without an acting prosecutor, which means that currently the prosecutors cannot receive their salaries, this was stated by the chairman of "Continue the Change" Asen Vassilev on the sidelines of the parliament, quoted by dariknews.bg.
On October 2, the Criminal Chamber of the Supreme Court of Cassation announced that it had refused to initiate proceedings on requests filed by the acting chief prosecutor for the resumption of criminal cases, because it does not recognize his legitimacy. According to the board, his powers are terminated after the six-month period from the entry into force of the provision by which he was designated as acting prosecutor, which is why the requests for the resumption of a criminal case filed by the acting prosecutor general after July 21 do not constitute a valid referral.
"Every pay slip, every bonus, every wage order that Mr. Sarafov signed after July 21 is illegal. We are reporting the "State Financial Inspection" agency, the Sofia City Prosecutor's Office and the prosecutor investigating the Prosecutor General, because currently Mr. Sarafov is in the role of a bum who spends 1 billion leva per year on the prosecutor's office. This is like you entering the prosecutor's office and saying "I am the prosecutor general and I will determine who gets what bonuses" and signing the prosecutors' pay slips. This is what the court told us. Everything was handed out without authority. Whoever signed them committed a crime in office and ordered extremely large sums of money from all taxpayers," Vassilev pointed out.
In his words, since the actions related to the disposal of cases are illegal, there is no way that the actions related to the disposal of money can be legal.
According to the leader of the DSB, Gen. Atanas Atanasov, there is a specific crisis in the judiciary. "The state cannot continue to function in this way and urgent measures are needed," Atanasov pointed out.
"In order to resolve this crisis, at least three things can be done. First, the Minister of Justice should stop hiding and convene the Plenum of the Supreme Judicial Council and raise this point, because it is critical. Second, the Minister of Justice can challenge the decisions of the Prosecutor's College and must do so. "Third, the permanent solution in the judiciary is to elect a new Supreme Judicial Council, but not under these rules," added Bozhidar Bozanov from the State Council.
