What we see in the National Assembly is a nightmare. The decision to have a working parliament during an election campaign, I don't know how good it is. It allows for parliamentary control over a government that the deputies did not elect. This is strange, because it was appointed by the president. The parliament can rather discourage people from voting if nothing changes by April 19. This was said by the constitutional law lecturer and former deputy Prof. Ekaterina Mihaylova in the studio of “Wake up“ on NOVA.
The constitutionalist is an opponent of caretaker government. “I do not accept the president's thesis that he is not responsible for the caretaker cabinet, since she did not elect it. I believe that the responsibility is shared between two people - the head of state and the candidate for prime minister. Yotova has given a vote of confidence, but if she does not accept part of the cabinet, she can return it until the problematic person is replaced. It is not true that nothing depends on the president, in fact it depends quite a bit. Gyurov reacted quickly precisely after Yotova's reaction to the Tsitelkov case. His decision to resign was accepted by President Iliana Yotova and acting prime minister Andrey Gyurov. The main reason for this outcome were allegations of a ban by the European Commission on participating in election observation missions for a period of five years, imposed in 2020. „Forgiveness is a very personal act, society cannot grant it collectively, because that would be contrary to its meaning. When there is something that could disturb someone's work in government, it must be checked. Such people are required to have a clean past, otherwise doubts arise. And this disables such a person. The rules of the National Assembly speak of ethical norms, such a law must be created. When you are going to take a position on which the fate of many people depends, there should be no doubt about your past, in view of the present and the future. Andrey Gyurov had to check Tsitelkov, but there was no way he could know everything - there are no mechanisms to do so while he is selecting the composition of the cabinet. Only state institutions can do a check. There must be a procedure that allows for the collection of general information before proposing ministers. It is not important that there is an active sentence, and that there is no violation of moral norms of behavior“, the professor commented.
According to Mihaylova, it is possible to end up with the removal of the acting prosecutor general, but she did not express optimism that this will happen with this composition of the SJC. “There are quite a few opinions from courts that say that there is a problem with this position. The SJC should comply with the court“, she believes.
